Common questions

What is probate?
Probate is the High Court's confirmation that a will is valid and that the executor can deal with the estate. Banks and other institutions often require it before releasing assets.
When is probate needed?
Usually when the person owned property in their sole name, or had significant assets (often over about $15,000 with one institution). Smaller estates may not need it.
How long does it take?
Once papers are filed correctly, a grant of probate from the High Court of New Zealand typically takes a few weeks. Gathering documents and finalising the estate takes longer.
What if there's no will?
If someone dies without a will (intestate), a close relative usually applies for 'letters of administration' instead, and the estate is distributed under set rules.
